Norm and "law" in the conception of the world in ancient China

Abstract
An attempt is made to roughly outline – against the background of the ancient Chinese conception of the world – the development of the idea of a state in the Chou period in China with its nexus of magical notions and their ensuing rationalisation in the interest of a political and sacral central power. In the system of macro-and microcosmic interrelations which dominated the conception of the world in ancient China – and China in general for thousands of years – the universe assumes "family" characteristics. A conception of the sacredness of right and law could hardly develop under conditions of "universal family ethics" and their peculiar and persistent rules of behavior. As a result of very ancient and tenacious ideas In China the concentration of power depended on ethical concepts and pretensions of the ruling class the supreme representation of which was "a son of heaven".

«Норма» и «закон» в мировоззрении древнего Китая.
В статье на фоне древнекитайского мировоззрения вкратце излагается возникновение государственной мысли в Китае периода Чжоу в связи с магическими представлениями, а также с их позднейшими рациональными переосмыслениями в духе политическо-сакральной центральной державы. В системе макро-микрокосмических соотношений, под господством которых находилось мировоззрение древнего Китая – а тысячелетиями и вообще мировоззрение Китая – вселенная принимает почти «семейные» черты. При условии «универсальной семейной этики» и присущих ей очень устойчивых норм поведения представление о священности права и закона едва могло возникнуть. Таким образом, концентрация власти на основе очень старых и весьма устойчивых представлений в Китае по крайней мере номинально основывалась на фундаменте этических ценностей и претензий господствующего класса, высшим представителем которого являлся «сын Неба».
